1. TERMS AND DEFINITIONS

1.1. Public offer (agreement) – an offer by the Contractor, addressed to any individual and/or legal entity, in accordance with Article 633 of the Civil Code of Ukraine, to conclude a public agreement for the provision of access services to the mydecorator.space service.
1.2. Acceptance – the Customer’s full and unconditional consent to conclude this Agreement on the terms set forth herein.
1.3. Contractor – FOP Zorina V.E. “My Personal Decorator” — EDRPOU code 2658612103, legal address: 18029 Cherkasy, 61 Sumgaitska St., office 29.
1.4. Service – the visualization of interior design on mydecorator.space.
1.5. Customer – an individual and/or legal entity, the user of the service, who has agreed to the Contractor’s Terms and Privacy Policy and registered in the manner established on mydecorator.space, to whom the Contractor provides services in accordance with the terms of this Agreement.
1.6. Service provision – the Contractor providing the Customer with access to mydecorator.space on a paid or free basis after the Customer completes registration in the manner established by this Agreement.
1.7. Paid services (professional plan) – provision, for a certain fee (monetary amount), of the service in the scope specified in this Agreement, which the Customer selects independently.
1.8. Free services (open plan) – provision by the Contractor to the Customer of limited access services (to restricted search information) available on mydecorator.space. The scope of limited access is determined by the Contractor at its sole discretion and may change without the Customer’s consent.
1.9. Trial period – a period of 1 (one) calendar day after the Customer’s registration on the Contractor’s service, during which the Customer receives free access to the service. The scope of information available during the trial period is determined by the Contractor at its sole discretion and may change without the Customer’s consent.
1.10. Service cost (tariff) – the payment amount set by the Contractor for providing a certain scope of services for Customer access to mydecorator.space.
1.11. Scope of services – capabilities, functionality, and content available to the Customer under a specific tariff plan, determining the Customer’s rights to use the Service.
1.12. Tariff plan – conditions that determine the scope of services available to the Customer for a certain period (2 days, 4 days, etc.) and the payment amount the Customer must make to obtain access. Functionality and the available information set do not depend on the paid period.
1.13. Personal data – information or a set of information about an individual who is identified or can be specifically identified.
1.14. Personal data subject – an individual whose personal data is processed in accordance with applicable law.
1.15. Consent of the personal data subject – a voluntary expression of will by an individual to permit the processing of their personal data for the specified purpose. Registration on mydecorator.space implies giving such consent.
1.16. Account – a collection of information about the Customer provided by them.


2. GENERAL PROVISIONS

2.1. Under the terms of this Agreement, the Contractor provides the Customer, and the Customer accepts, access services to mydecorator.space only after registration on the website and creation of an account.
2.2. The service is provided on a paid or free basis at the Customer’s choice by granting access to mydecorator.space.
2.3. All amendments and additions to this Agreement are published on the Contractor’s website.
2.4. All terms of this Agreement are binding for both the Customer and the Contractor. Before using the Service, the Customer must familiarize themselves with the terms of the Agreement. If the Customer does not agree with the terms, they are not entitled to use the services.
2.5. If the Customer disagrees with changes made by the Contractor to the Agreement or with new service tariffs, the Customer must stop using the service.
2.6. The Customer, as a personal data subject, upon registering on the service, gives consent to the processing of their personal data in the Contractor’s database and agrees to receive regular emails and other notifications from the service.

3. PROCEDURE FOR SERVICE PROVISION

3.1. The Customer independently registers on the service at mydecorator.space in the section “Choice of Interior Update Format” and automatically receives trial access.
3.2. Paid access is available after the Customer registers and selects a specific service package in the manner provided by these Terms. Paid access grants full access to all sections and functionality of the system.
3.3. If payment has not been made or renewed after the paid period, access is provided within the open access limits (without registration), which implies certain restrictions.
3.4. The Customer pays for service access in advance for the chosen period.
3.5. Access to the service, as a computer program, is considered the supply of software under item 26 of subsection 2 of Section XX “Transitional Provisions” of the Tax Code of Ukraine and is exempt from VAT.
3.6. The Contractor reserves the right, at its sole discretion and at any time, to change the terms of tariff plans. The Customer may switch their tariff plan at any time to another plan offered by the Contractor at that moment. Changes to tariff plans do not apply to periods already paid for by the Customer and take effect after the expiration of the paid service period.
3.7. Tariff plan terms and service scope conditions are an integral part of these Terms and are mandatory for all Customers. Additional provisions regarding access to the Service may be posted in the Service — they also form an integral part of these Terms.


4. ACCOUNT

4.1. To use the Service functionality, the Customer must register an Account. Registration requires: (a) providing a first name, last name, and email address, or (b) authorizing via Facebook or Google.
4.2. By registering on the Service, you confirm that you are a legally capable individual acting on your own behalf or on legal grounds on behalf of a legal entity. You also confirm that all information provided during registration is accurate, truthful, and up-to-date.
4.3. The procedure for storing and processing personal data of individuals by the Customer is established in the Privacy Policy.


5. RIGHTS AND OBLIGATIONS OF THE PARTIES

5.1. Contractor’s Obligations
5.1.1. Provide services to the Customer according to the paid service scope.
5.1.2. Maintain the confidentiality of the Customer’s personal data obtained during Account registration and/or use of the service.
5.1.3. Upon Customer’s request, provide Acceptance Certificates electronically using a digital signature (EDS) compliant with legal requirements.

5.2. Contractor’s Rights
5.2.1. Terminate paid service provision upon expiration of the service period.
5.2.2. Change the procedure for service provision and their cost without renegotiating the Agreement by publishing changes on mydecorator.space.
5.2.3. Disclose any information if required under Ukrainian law, upon request of authorized state authorities, and to ensure the proper functioning of mydecorator.space or protect the Contractor and Customer(s), provided this does not contradict constitutional rights and applicable Ukrainian legislation.

5.3. Customer’s Obligations
5.3.1. When using paid services, timely pay the Contractor for services according to the scope, procedure, and deadlines specified in the Agreement.
5.3.2. Comply with the terms of the Agreement.
5.3.3. Not resell or provide service results to third parties.
5.3.4. Familiarize themselves with the Agreement, terms of the selected services, and comply with their requirements.
5.3.5. Keep network credentials (logins, passwords) confidential.
5.3.6. Not collect, copy, or process personal data of others or any other information posted on the Service, including through parsing (use of parser programs, “spiders,” and their equivalents).

5.4. Customer’s Rights
5.4.1. Receive information about services and tariffs.
5.4.2. Use the Service within the functionality available under the selected tariff plan, in accordance with these Terms.
5.4.3. Request an Acceptance Certificate electronically with EDS from the Contractor.
5.4.4. In case of questions/complaints/suggestions, contact technical support via the relevant Service functionality or email provided on mydecorator.space.

6. SERVICE COST AND PAYMENT PROCEDURE

6.1. The cost of Services is determined according to the current tariff plans published on the website mydecorator.space and at the link: https://mydecorator.space/#prices. Prices are indicated in the national currency of Ukraine.
6.2. Payment for Services is made by the Customer via non-cash transfer to the Contractor’s settlement account.
6.3. Services are provided upon payment of 100% of the amount after the funds are received in the Contractor’s account. The service provision start date is the date the funds are received from the Customer.
6.4. The Customer is solely responsible for the correctness of the payments made.


7. SERVICE INFORMATION

7.1. The Service may contain publications, articles, and other informational materials of journalistic, analytical, or other nature. The authors of such materials may be the Contractor or other persons. The Contractor is not responsible for the accuracy of these materials or the consequences of their use.
7.2. Data obtained from third-party resources are open data from official sources, Google search engines, or other third-party resources authorized to collect, process, and transmit data according to Ukrainian law. The Service collects, analyzes, and uses data from open sources, including (but not limited to) datasets subject to disclosure under Cabinet of Ministers Resolution No. 835 “On Approval of Regulations on Datasets to be Published as Open Data,” in accordance with the Law of Ukraine “On Access to Public Information.”
7.3. The accuracy and correctness of the data in the Service depend on the correctness of such data from third-party resources. The Contractor is not responsible for the content of such data or the consequences of their use.
7.4. The Service may contain links to third-party websites, web pages, and applications. The Customer is solely responsible for reviewing the terms of use of these resources and agrees that they use them at their own risk and bear full responsibility for their actions.


8. LIABILITY OF THE PARTIES

8.1. The Contractor is not responsible for the completeness or accuracy of any information (including aggregated and analytical data) based on machine analysis of data obtained from official public information sources and third-party resources.
8.2. Aggregated data, visualizations, connections, and analytical information in the Service are for informational purposes only. The Customer uses them to make decisions at their own discretion, and the Contractor is not liable for the consequences of their use.
8.3. If the Customer is dissatisfied with the terms and/or quality of the Service, it is recommended to stop using it.
8.4. The Contractor is not liable for any damages (direct, indirect, incidental), including lost profits, arising from service disruptions, usage, or inability to use the Service. The Contractor is also not responsible for any actions or inactions of persons and their consequences related to the use of information obtained from the Service, unless otherwise provided by law.
8.5. For non-performance or improper performance of obligations under these Terms, the Parties are liable in accordance with applicable Ukrainian law.
8.6. The Customer agrees not to violate or attempt to violate these Terms. If the Contractor determines that the Customer has violated or attempted to violate the Terms, the Customer’s access to the Service may be terminated; the Contractor may restrict access, block, or delete the Account in connection with the violation of the Agreement.

9. REFUND PROCEDURE

9.1. The Customer has the right to a refund if they notify the Contractor within 24 hours after making the payment via email to info@mydecorator.space
9.2. The request must include information from the “My Profile” section, namely: User ID, first name, last name, email, and registration address.
9.3. Funds will be returned to the account from which the payment was made within 3 business days after receiving the request with all necessary information.


10. DISPUTE RESOLUTION PROCEDURE

10.1. These Terms and the relationship between the Parties are governed by the laws of Ukraine.
10.2. All disputes arising in connection with these Terms (including issues of execution, conclusion, validity, or termination) should be resolved by the Parties through negotiations.
10.3. The Customer agrees that for dispute resolution between the Parties, communication via email and/or phone is considered effective and binding.
10.4. If the Parties cannot reach an agreement on a dispute within 30 calendar days, the dispute is submitted to the competent court in accordance with Ukrainian law.


11. INTELLECTUAL PROPERTY RIGHTS

11.1. All components of the Service as a whole belong to the Contractor and are protected under intellectual property law.
11.2. The Contractor shall have the unrestricted right to use the design materials created under this Agreement on their website, in portfolio presentations, and for any promotional or advertising purposes, without further consent from the Client.
11.3. Use of any materials or elements of the Service for commercial purposes without the Company’s written permission is strictly prohibited.


12. FINAL PROVISIONS

12.1. The Parties agree to use electronic digital signatures (EDS) in document flow within the framework of this Agreement (Terms).
12.2. The Customer has the right to terminate these Terms unilaterally at any time by deleting their Account. To delete the Account, a request must be sent via email to the Contractor.
12.3. The Contractor has the right to terminate these Terms unilaterally at any time.
12.4. The Contractor has the right to make changes or additions to these Terms at any time without special notice by posting the new version of the Terms in the corresponding Service section. The new version comes into effect from the moment of posting unless otherwise provided. The Customer must periodically review the current Terms. If the Customer continues to use the Service 5 (five) calendar days after changes, this constitutes full and unconditional acceptance of such changes.
12.5. All inquiries regarding the use of the Service, including those provided for in these Terms, must be sent to the Company at info@mydecorator.space
